1. Acceptance of Terms

By accessing or using Snapchart (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. NOT FINANCIAL ADVICE - CRITICAL DISCLAIMER

READ CAREFULLY:

  • Snapchart is NOT a financial advisor. We are not registered as a broker-dealer, investment advisor, or financial institution. The Service provides educational and informational content only.
  • All content is educational, NOT advice. Any signals, indicators, patterns, buy/sell suggestions, price predictions, entry/exit points, support/resistance levels, trend directions, or trading opportunities provided by the Service (whether AI-generated or otherwise) are for educational and informational purposes ONLY and do NOT constitute investment advice, recommendations, or solicitations to buy or sell securities.
  • Do NOT rely on AI signals for trading decisions. AI-generated signals, analysis, or insights are experimental, educational tools only. They are NOT vetted investment recommendations. Making trading decisions based on AI output is done entirely at your own risk.
  • AI is inherently unreliable. AI-generated content may be inaccurate, incomplete, misleading, biased, hallucinated, outdated, or completely wrong. AI cannot predict market movements. Do not trust AI output without conducting your own independent research and analysis.

  • Trading involves substantial risk. You can lose your entire investment and more. Leverage, margin, and derivatives can amplify losses. Only trade with money you can afford to lose.
  • Past performance is not indicative of future results. Historical data, backtests, and patterns do not predict future market behavior. Markets can remain irrational longer than you can remain solvent.
  • No guarantee of accuracy or timeliness. Market data, charts, signals, and analysis may be delayed, inaccurate, incomplete, or unavailable. Do not rely on real-time accuracy.
  • Consult licensed professionals. Before making any investment decisions, consult with a licensed financial advisor, CPA, or attorney who understands your personal financial situation. Snapchart is not a substitute for professional advice.
  • Educational use only. Use the Service to learn about technical analysis and market patterns, NOT to make actual trading decisions. Paper trade and test strategies extensively before risking real capital.

3. Eligibility

You must:

  • Be at least 18 years old
  • Have the legal capacity to enter into binding contracts
  • Not be prohibited from using the Service under applicable laws
  • Comply with all local laws regarding online conduct and trading

4. Account Responsibilities

You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Accept responsibility for all activities under your account
  • Not share your account with others

5. Prohibited Uses

You may NOT:

  • Use the Service for illegal purposes or to violate any laws
  • Reverse engineer, decompile, or disassemble the Service
  • Scrape, mine, or extract data without authorization
  • Distribute malware or viruses
  • Impersonate others or provide false information
  • Interfere with or disrupt the Service
  • Attempt to gain unauthorized access to our systems
  • Use automated systems (bots) without permission
  • Resell or redistribute the Service without authorization
  • Use the Service to provide financial advice to others

6. Intellectual Property

All content, features, and functionality of the Service are owned by Snapchart and protected by copyright, trademark, and other intellectual property laws. You may not:

  • Copy, modify, or create derivative works
  • Use our trademarks without written permission
  • Remove copyright or proprietary notices

7. User Content

By submitting content (charts, messages, feedback), you grant us a worldwide, royalty-free license to use, reproduce, and display that content for providing and improving the Service. You represent that:

  • You own or have rights to the content you submit
  • Your content does not violate any laws or third-party rights
  • Your content does not contain malicious code

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • Service provided "AS IS" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement.
  • We are not liable for trading losses, missed opportunities, financial damages, or lost profits of any kind, regardless of whether you relied on AI output, signals, patterns, or any Service content.
  • We are not liable for AI errors, hallucinations, bugs, glitches, downtime, data loss, data corruption, or inaccurate information.
  • We are not liable for indirect, incidental, consequential, special, exemplary, or punitive damages, even if advised of their possibility.
  • We are not liable if AI accidentally generates content resembling trading signals, recommendations, or actionable insights. Using such content is entirely at your own risk.
  • We are not liable for the performance of any AI signals, patterns, or analysis, whether provided intentionally as a feature or generated accidentally. No guarantee of profitability or accuracy exists.
  • Our total liability for all claims arising from your use of the Service shall not exceed the lesser of (a) $100 USD or (b) the amount you paid to Snapchart in the 12 months preceding the claim.
  • No guarantee of uptime, availability, accuracy, completeness, reliability, or fitness for trading purposes.
  • California residents: You waive California Civil Code Section 1542, which states: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party."

9. Indemnification

You agree to indemnify, defend, and hold harmless Snapchart, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your trading decisions or activities
  • Your violation of any third-party rights

10. Service Modifications and Termination

We reserve the right to:

  • Modify or discontinue the Service at any time without notice
  • Change pricing and subscription terms
  • Suspend or terminate your account for violations
  • Refuse service to anyone for any reason

11. Subscription and Payments

If you purchase a premium subscription:

  • Subscriptions auto-renew unless canceled
  • All fees are non-refundable unless required by law
  • Premium features (including AI signals/analysis if available) are educational tools, NOT financial advice
  • No refunds will be issued for trading losses or poor signal performance
  • We may change pricing or features with 30 days' notice
  • You authorize us to charge your payment method
  • Failure to pay may result in immediate suspension of service

12. Privacy

Your use of the Service is subject to our Privacy Policy, which is incorporated into these Terms by reference.

13. Third-Party Services

The Service may integrate with third-party platforms (TradingView, brokers, etc.). We are not responsible for:

  • Third-party service availability or functionality
  • Third-party terms, policies, or practices
  • Data accuracy from third-party sources

14. Dispute Resolution

14.1 Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. You agree to submit to the personal jurisdiction of courts located in California.

14.2 Binding Arbitration

Any disputes, claims, or controversies arising from these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules. Arbitration shall take place in California.

Class Action Waiver: You agree to bring claims only in your individual capacity and not as a plaintiff or class member in any class, collective, or representative action. You waive the right to participate in class actions, class arbitrations, or representative actions.

Exception: You may assert claims in small claims court if they qualify and remain in small claims court.

14.3 Costs

Each party shall bear their own costs and attorney's fees unless otherwise awarded by the arbitrator or court.

15. California Consumer Rights

If you are a California resident, you have certain rights under the California Consumer Privacy Act (CCPA). Please see our Privacy Policy for details on data collection and your rights.

16. Geographic Restrictions

The Service may not be available in all jurisdictions. You are responsible for compliance with local laws. We make no claims that the Service is appropriate or legal in your location.

17. Regulatory Compliance

Snapchart is not registered as a broker-dealer, investment advisor, or financial institution. We do not hold, manage, or have access to your trading funds.

18. Force Majeure

We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to: acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, network infrastructure failures, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

19. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full effect.

20. Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and Snapchart regarding the Service.

21. Changes to Terms

We may modify these Terms at any time. Changes will be effective immediately upon posting. Continued use of the Service constitutes acceptance of modified Terms. For material changes, we will provide notice via email or prominent Service notification.

  • You understand this Service provides NO financial advice or investment recommendations
  • Any signals, analysis, or insights provided (including AI-generated content) are educational tools only and NOT advice
  • You will NOT make trading decisions based solely on Service content, AI signals, or analysis without conducting your own research
  • You will conduct your own due diligence and consult licensed professionals before trading
  • You waive any claims against Snapchart for losses arising from Service use or reliance on any content
  • You understand that paying for premium features does NOT convert educational content into advice
